Spousal Open Work Permit (SOWP)

Open work permit for spouses and common-law partners of Canadian work permit holders, study permit holders, or PR sponsors. Lets you work anywhere in Canada for any employer.

The Spousal Open Work Permit (SOWP) lets the spouse or common-law partner of certain temporary residents work in Canada — for any employer, anywhere, any occupation — without needing a job offer or LMIA. Major eligibility cuts in January 2025 and again in early 2025 dramatically narrowed who qualifies. This page covers the current 2026 rules.

Spouse of a Canadian PR being sponsored (inland)

If a Canadian citizen or PR is sponsoring you for permanent residence (inland sponsorship), you can apply for an SOWP under section R207 immediately after filing the sponsorship application. This is one of the most reliable SOWP pathways and was NOT affected by the 2024–2025 changes.

Documents you'll need

  • Proof of relationship — marriage certificate OR common-law evidence (12+ months cohabitation: joint lease, shared bills, joint bank account)
  • Copy of principal's study permit, work permit, or PR application receipt
  • For student spouses: principal's enrolment confirmation showing program type and length
  • For worker spouses: principal's employment letter showing TEER level + duties (must match TEER 0/1 list)
  • Valid passport (entire SOWP duration + 6 months)
  • Recent passport-style photo
  • If applying from outside Canada: police certificates (some countries)

Step-by-step SOWP application

  1. Confirm principal's eligibility — pull up the current rules above and confirm the principal's program/permit qualifies
  2. Gather relationship evidence — this is the most scrutinized part. Marriage certificate is straightforward; common-law requires 12+ months of shared address with documentation.
  3. Apply online via IRCC portal — inside Canada or outside Canada
  4. Provide biometrics if not on file (CAD $85)
  5. Wait for decision — 4–8 weeks typical
  6. If outside Canada and approved: receive Port of Entry Letter; physical permit issued at the border

Common SOWP refusal reasons

  • Principal doesn't qualify under new rules — most common refusal post-2025. Bachelor's spouses, TEER 2/3 worker spouses, sub-16-month master's spouses get refused.
  • Genuineness of relationship doubted — insufficient cohabitation evidence; rushed marriage; large age gap with no relationship history
  • Principal's status precarious — restoration pending, expired permit, etc.
  • Wrong TEER claimed — principal's actual duties don't match the TEER claimed
  • Misrepresentation — failing to declare a prior relationship, incorrect family info

What happens when the principal's permit expires

Your SOWP is co-terminus with the principal's permit. When they renew, you must renew simultaneously — your SOWP cannot extend independently. If the principal's status lapses, your SOWP also lapses.

SOWP → PR strategy

Time on an SOWP counts as full-time Canadian work experience for both you and the principal's future Express Entry applications:

  • 12 months of TEER 0/1/2/3 work on SOWP → CEC eligibility for YOU directly
  • If you're named as principal applicant for PR (your CRS is higher), the spouse who holds the original permit becomes the accompanying spouse
  • Build your own profile — language tests, ECA — even if your spouse is the "primary" candidate today
